Terms and Conditions

1. Scope

The following General Terms and Conditions of Business exclusively apply to each and every transaction concluded or entered in our online shop as well as for standard purchase methods between Shop of Phantoms / AirDOC Verlag and customers that are deemed consumers under clause 13 German Civil Code (Buergerliches Gesetzbuch – BGB).

2. Conclusion of contract

The contract comes into being by the acceptance of the order by Shop of Phantoms / AirDOC Verlag. The customer refrains from the receipt of an acceptance declaration according to clause 151 (1) German Civil Code (BGB).
The notification of the customer about the conclusion of the contract is carried out by Shop of Phantoms / AirDOC Verlag by either an order confirmation or at delivery at latest. When ordering via Shop of Phantoms / AirDOC Verlag web shop, the order confirmation is carried out by e-mail immediately.

3. Right of revocation

You have the right to cancel this contract within 14 days without stating any reasons.

The withdrawal period is 14 days from the date on which you or a third party named by you, which is not the carrier, have taken physical possession of the goods.

To execute your right of revocation, you must notify us, Shop of Phantoms / AirDOC Verlag, Wetterkreuz 13, 91058 Erlangen, GERMANY, e-mail: info@shopofphantoms.com by a distinct statement (e.g. a letter sent by mail or e-mail) on your decision to withdraw from this contract. You can use the attached sample withdrawal form which is not mandatory, however.

In order to observe the revocation period it is sufficient for you to send the message about the right of revocation prior to the revocation deadline.

Effects of revocation:

If you withdraw from this contract, we will refund all related payments that we have received from you, including delivery costs (with the exception of additional costs arising from the fact that you have chosen an expensive type of delivery other than the cheapest standard delivery offered by us), and refunded immediately, latest within 14 days from the date on which we have received the notice of the cancellation of this contract. For this refund we will use the same method of payment that you have used for the initial transaction, unless an explicitly otherwise agreement; in no case you will be charged fees for this repayment. We may refuse payment of the reimbursement until we have received the goods back or until you have verified that you have returned the goods, whichever is the earlier date.

You have to return the goods promptly and in any case not later than 14 days from the date on which you notify us of the revocation of this contract, either by sending back or handing over. The deadline is met if the goods are dispatched before the expiration of the deadline of 14 days.

You have to bear the direct costs for returning the goods.

You have to pay for any diminished value of the goods only, if this deterioration in value is attributed to the verification of nature, characteristics and functioning of the goods.

4. Conditional availability

Paid orders are processed within 7 to 10 working days from the date of receipt. In case an ordered and paid for item is not available it will be shipped free of charge (shipping costs) upon arrival at Shop of Phantoms / AirDOC Verlag web shop – delivery times therefore may vary from 2 to 6 six weeks. Should Shop of Phantoms / AirDOC Verlag find out that an ordered and paid for item is no longer available from manufacturers/suppliers or out of production Shop of Phantoms / AirDOC Verlag is entitled to offer an item equal in price and quality. In case the customer refuses this offer and cancels his or her, Shop of Phantoms / AirDOC Verlag will immediately refund the customer. Shop of Phantoms / AirDOC Verlag has the right of cancellation of an order for items which are no longer available or which cannot be shipped due to legal or other reasons. Already received payments for such an order will be refunded by return of the cancellation of an order.

5. Prices

All prices stated in Shop of Phantoms / AirDOC Verlag online shop are gross prices in EURO, including currently applicable German VAT of 19 % (non-EU customers are not charged VAT). Additional prices arise for postage and packing (see below) and will be added on check-out. Shop of Phantoms / AirDOC Verlag has the right to alter prices according to VAT and price increase from manufacturers, suppliers and shipping service providers without separate notice. Specific costs such as import tax for foreign countries have to be borne by the customer.

7. Orders / Low order fee

Each and every order is based on these GTC in its valid version. Orders can be placed online via Shop of Phantoms / AirDOC Verlag web shop, by letter or e-mail. Minimum order value is 10,00 Euros.
Shipping is carried out by Deutsche Post DHL Group only.

8. Terms of payment

Payment has to be carried out in advance without allowance by the following options:

Payment options for customers outside Germany:

SOFORT Überweisung *) (presently for Austria, Belgium, Czech Republic, France, Hungary, Italy, Netherlands, Poland, Slovakia, Spain, Switzerland and United Kingdom only)

When paying by bank transfer, all fees have to be borne by the customer. The customer has to ensure that the total amount of the invoice without allowance will be credited to the account of Shop of Phantoms / AirDOC Verlag.

Shop of Phantoms / AirDOC Verlag cannot be made responsible for the loss of money which is transferred by letter post or other kind of dispatch.

Important note: Orders, for which payments are not credited to the bank account of Shop of Phantoms / AirDOC Verlag within seven working days (except Sunday) from date of order, will be cancelled without any further request of information on the part of Shop of Phantoms / AirDOC Verlag.

*) Note: The operator of the service SOFORT Überweisung, the SOFORT GmbH, has concluded an insurance in your favour, which supersedes the claim for unauthorised use according to the conditions of insurance at this link **).
Thereby you shall be protected against possible risks of liability in the scope of the insurance coverage. In this context we point out that a lot of banks assume that use of the service SOFORT Überweisung by using your PIN and TAN will lead to a shift of liability in case of possible misuses by third parties.
This may lead to a refusal by your bank for taking over the claim, resulting in having to bear the claim by yourself. However, it has to be pointed out that no misuse has turned up at the service SOFORT Überweisung up to now (Technical Supervisory Association certified online banking system). Furthermore the a. m. insurance-protection exists.

9. Place of fulfilment

Place of fulfilment for shipments and payments is 91058 Erlangen.

10. Warranty

The customer has to report Shop of Phantoms / AirDOC Verlag about any faulty or defective items in written form within 7 days after receipt of the supply.
The warranty is limited to replacement or remedy, opted by Shop of Phantoms / AirDOC Verlag only.

11. Agreement for bearing of costs and expenses

Should the customer make use of his or her right of revocation, he or she has to bear the direct costs for returning the goods.

12. Retention of title

All goods delivered will remain property of our company until full payment is made.

13. Miscellaneous

Prices, errors and feasibility of supply are subject to change.
According to § 86/86a Strafgesetzbuch (public German penal law) decal sheets for aircraft models of German Luftwaffe WW II and Finnish Air Force WW II must not contain swastikas.

14. Mediation

The European Commission provides a platform for online mediation (OS), which you will find at https://ec.europa.eu/consumers/odr/. Customers have the opportunity to make use of this platform for the settlement of their disputes.

We are not participating in a dispute settlement procedure before a consumer arbitration board. However, the law on alternative dispute resolution in consumer goods requires that we nevertheless point out a consumer arbitration board responsible for you:
